TERMS AND CONDITIONS FOR PROVIDING ELECTRONIC SERVICES

AND CONCLUDING DISTANCE SALES AGREEMENTS

within the online store www.rhinst.pl

§ 1 Definitions
  1. Store: the service provider’s online store at the internet address
    rhinst.pl
  2. Seller: the owner of the online store M-Market Decoration Sp. z o.o. operating at the address: ul. Limanowskiego 129/133, 91-340 Łódź.
  3. Customer: a client or consumer entering into a sales agreement with the Seller.
  4. Sales agreement: a sales agreement concluded between the Customer and the Seller through the online store.
  5. Product: an item that is the subject of the sales agreement.
  6. Customer Account: an individual customer panel created after registration and conclusion of the agreement for providing Customer Account services.
  7. Password: alphabetic, numeric, and special characters used to secure access to the Customer Account in the online store.
  8. Registration Form: a form available in the online store for creating an individual Customer Account.
§ 2 General Provisions
  1. The general conditions, rules, and method of sale in the
    rhinst.pl
    store are defined by the Terms and Conditions of the online store.
  2. The customer is obliged to familiarize themselves with the Terms and Conditions before concluding the agreement and is bound by its provisions at the time of placing an order.
  3. Placing an order signifies agreement with all provisions of the Terms and Conditions.
  4. To place an order in the Online Store and use the services provided electronically through the Online Store, it is necessary for the Customer to have an active email account.
§ 3 Registration
  1. Registration is not necessary to place an order.
  2. The customer can register by filling out the registration form on the store’s website and sending it electronically to the Seller.
  3. The Seller confirms the registration after receiving the completed registration form electronically to the email address provided by the Customer in the form. This is equivalent to concluding an agreement for providing Customer Account services electronically.
  4. A customer with a Customer Account has access to it and can make changes to the data provided during registration.
  5. The customer provides personal data voluntarily and consents to the use of personal data by the Online Store solely to the extent and purpose necessary for order fulfillment.
§ 4 Orders
  1. Customers can place orders for products in the Online Store 7 days a week, 24 hours a day. Order confirmation emails are sent during the working hours of the Online Store administrators from Monday to Friday, 10:00 AM – 5:00 PM.
  2. Adding products to the Cart is not equivalent to placing an order. The order is accepted for processing after filling out the order form, selecting the delivery method, payment method, total price, and confirming the purchase by clicking the “Buy and Pay” button.
  3. During the ordering process, the Customer is informed about the total amount of the order for selected products and delivery, as well as all additional costs associated with the order.
  4. Placing an order is equivalent to concluding a Sales Agreement for the Products that are the subject of the order.
  5. After placing an order, the Seller sends a confirmation to the email address provided by the Customer.
  6. Order fulfillment depends on product availability from the manufacturer and stock levels.
  7. Products customized to individual Customer orders require a deposit of 50% of the order value.
§ 5 Payments
  1. The customer has the option to choose the payment method for the ordered product:
    1. Bank transfer to the Seller’s account: 39 2490 0005 0000 4530 4807 2774. The order will be processed after the payment is credited to the Seller’s account.
    2. Bank transfer via the Przelewy24.pl system. The order will be processed after the Seller receives information from the Przelewy24.pl system about the Customer’s payment.
    3. Cash on delivery. The order will be processed after the Seller confirms acceptance of the order for fulfillment.
  2. When choosing the “bank transfer” payment method, the customer is obliged to make the payment no later than the day following the order placement. Otherwise, the order will be canceled, and the Seller has the right to withdraw from the agreement.
  3. Prices for products sold in the online store are gross prices (including VAT).
  4. Product prices on the Store’s Website do not include shipping costs. The Customer will be informed during the ordering process and payment method selection about all additional costs associated with concluding the Sales Agreement.
§ 6 Delivery
  1. Delivery is carried out within the territory of the Republic of Poland.
  2. After the Customer selects the shipping method and payment form, the Seller will inform the Customer about the number of business days needed to process the order and complete the Delivery.
  3. Ordered Products are delivered to the Customer via the chosen delivery method to the address provided by the Customer in the order form.
  4. The Customer is informed on the day of shipping about the dispatch of the package by the Seller.
  5. Depending on the delivery method, the Customer is obliged to check the quality of the delivered package and its contents. In case of any irregularities, missing Products, or damage, the Customer is required to prepare an appropriate report in the presence of the Delivery person.
  6. A damage report is necessary to initiate the complaint process with the Delivery provider.
  7. The customer has the option to choose the form of sales document as a receipt or VAT invoice. The document can be attached to the shipment or sent electronically. The Customer is obliged to inform the Seller at the time of placing the Order by selecting the appropriate field in the order form about the need to issue a VAT invoice.
  8. In case of non-collection of the ordered Product by the Customer at the specified Delivery address, the Seller will arrange with the Customer electronically a new delivery date and cost.
§ 7 Warranty
  1. All products sold by the Seller are covered by a warranty provided by the manufacturer or distributor.
§ 8 Complaints
  1. The condition for initiating the complaint procedure is the presentation by the Customer of the original proof of purchase delivered with the Product and submitting a written complaint report to the Seller’s address. The Customer is obliged to describe the problem that has occurred.
  2. The Seller will present their position regarding the complained Product within 14 days from the date of submitting the complaint report.
  3. In case of a complaint, please contact the Seller to obtain additional information regarding the shipment of the complained product and further proceedings.
  4. For justified complaints, the damaged product is repaired or replaced with another full-value product, and if this is not possible (e.g., discontinuation of the product or stock depletion), the Seller will refund the equivalent of the product price or offer another with matching parameters and specifications.
  5. In the case of a justified complaint, the delivery costs are borne by the Seller.
§ 9 Withdrawal from the Sales Agreement
  1. According to the Act of May 30, 2014, “On Consumer Rights” (Journal of Laws of June 24, 2014), the buyer has the right to withdraw from the purchase (withdraw from the distance contract) within 14 days, without giving a reason.
  2. In case of withdrawal from the Distance Sales Agreement, the Agreement is considered not concluded.
  3. The period for withdrawal from the Sales Agreement begins from the moment the Product is delivered to the Customer.
  4. A Customer who is a Consumer may withdraw from the Sales Agreement by submitting a declaration of withdrawal in writing via email to the Seller’s address or through the form provided by the Seller on the Store’s Website.
  5. The Customer is obliged to return the product to the Store immediately after submitting the declaration of withdrawal from the agreement.
  6. The Seller will check the condition of the returned product within 3 business days of receiving the shipment. The product must be in full value and show no signs of use or damage. The Consumer is responsible for any decrease in the value of the Product resulting from delivering a non-full-value Product to the Seller.
  7. Within 7 days of checking the product, the Seller will refund the Customer the paid amount minus the order processing costs to the specified bank account or through the chosen payment system.
  8. The Customer who is a Consumer bears the costs of returning the Product.
  9. In case of returning a product that is not in stock and was procured at the Customer’s request or personalized, the refundable amount will be reduced by the paid deposit.
§ 10 Personal Data Protection
  1. The principles of Personal Data Protection can be found in the Privacy Policy section on the Online Store’s website www.rhinst.pl/polityka-prywatnosci/
§ 11 Final Provisions
  1. The Seller reserves the right to change these Terms and Conditions. Orders placed before the introduction of changes will be processed in accordance with the rules in force in the Terms and Conditions current on the day of the order.
  2. In the event of a dispute arising from the concluded Sales Agreement, the parties will strive for an amicable resolution. Polish law is the applicable law for resolving disputes.
  3. The Terms and Conditions come into force on: 01.01.2023.
